Nothing evidences a subject’s maturity so convincingly as the emergence of introductory texts.It may be said that over the past two decades feminist legal theory and jurisprudence has come of age. The literature is now both extensive and impressive, although sometimes inaccessible to many students because it is dispersed amongst international journals. It is the objective of this book to introduce students to the major themes of inquiry and scholarship with which feminist scholars, many of whom are lawyers, are concerned. Feminist jurisprudence has many objects of inquiry, and seeks to answer many difficult, sometimes intractable, questions about law and society.If there is one single, unifying strand of thought amongst feminist legal scholars, it may be interpreted as the unmasking of the many inequalities based on gender, deriving from nature and culture and encapsulated in the law.Equally important are the practical implications of this area of study – nothing less than the search for equality for women under the law. Preface. THIS book is based on a doctoral thesis submitted at the University of Oxford. I wish to acknowledge my great indebtedness to Prof. H. L. A. Hart. I learnt much from his published works, from his lectures, and most of all from his very patient and detailed criticism of previous drafts of this study. I am also most grateful to him for his constant encouragement and guidance. I am greatly indebted to Dr. P. M. Hacker, with whom I had many illuminating conversations on the topics discussed, and to Dr. A. Kenny, who read and commented on two papers I wrote on Bentham and Kelsen; these served as a basis for some of the material in Chapters 3-5. My stay at Oxford was made possible by the Hebrew University, Jerusalem, which secured the necessary funds, and especially by the kind attention and interest of Mr. E. Posnansky.Both Professor Hart and Dr. Hacker read previous drafts of the book, and if it were not for their pains there would be many more mistakes and stylistic infelicities in the English than in fact remain. However, in addition not intended as a textbook that is comprehensive, in general, these books were written in the period before the reform. Therefore, the text books that are still used as a handle in constitutional law courses in various faculties of law in our country today has a lot of outdated.
